Last updated: October 17, 2026 PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING OR USING FAIRWAY BATTLE, YOU AGREE TO BE BOUND BY THESE TERMS. 1. ACCEPTANCE OF TERMS By creating an account or using the Fairway Battle platform ("Platform"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Platform. 2. PLATFORM DESCRIPTION Fairway Battle provides golf event management software to pro shop operators ("Pro Shops") and individual golfers ("Players"). The Platform facilitates event creation, score tracking, and credit distribution. Fairway Battle is not a gambling operator, financial institution, or sports wagering service. 3. PRO SHOP ACCOUNTS Pro Shop accounts are subject to a subscription fee. Pro Shops are solely responsible for (a) the events they create and operate; (b) ensuring compliance with all applicable laws; (c) the accuracy of scoring and payout distributions; and (d) handling any player disputes. 4. PLAYER ACCOUNTS Players must be at least 13 years of age. Players must be at least 18 years of age to participate in player-managed matches. Players are responsible for the accuracy of scores they submit. 5. PRO SHOP CREDIT Winnings distributed through the Platform are in the form of pro shop credit ("Credit"). Credit has no cash value and may only be redeemed for goods or services at the issuing pro shop. Fairway Battle makes no guarantee as to the availability, value, or redemption terms of Credit. 6. PROHIBITED USES You may not use the Platform to facilitate illegal gambling, money laundering, or any activity that violates applicable law. You may not misrepresent your scores or identity. 7. INTELLECTUAL PROPERTY All Platform content, software, and trademarks are owned by Fairway Battle or its licensors. You may not copy, modify, or distribute Platform content without written permission. 8. DISCLAIMER OF WARRANTIES THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. FAIRWAY BATTLE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF SECURITY VULNERABILITIES. 9. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAIRWAY BATTLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. 10. GOVERNING LAW These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. 11.
